IHC Rules Sher Afzal Marwat Cannot Be Arrested Without Court Approval

The Islamabad High Court (IHC) has ruled that Pakistan Tehreek-e-Insaf (PTI) leader Sher Afzal Marwat cannot be arrested without prior approval from the court.

This decision was issued in a written order by Justice Saman Rafat Imtiaz following a petition filed by Sher Afzal, seeking protection from any secret charges or arrest.

The court has also issued notices to the Secretary of Interior, the Inspector Generals of Islamabad and Punjab, and the Federal Investigation Agency (FIA). These parties are required to submit para-wise comments in response to the petition.

The High Court has requested details of any cases filed against Sher Afzal, noting that he fears being secretly charged and arrested, as claimed by his legal counsel. The court made it clear that no arrest can be made without its explicit consent.

The petition was filed by Sher Afzal’s lawyers, Adil Aziz Qazi and Riyasat Ali Azad.

Previously, Islamabad police arrested PTI Chairman Barrister Gohar Ali Khan and MNA Sher Afzal Marwat outside Parliament House following a National Assembly session. A heavy police presence had gathered, and as PTI leaders exited, police swiftly moved to detain Sher Afzal.

A scuffle reportedly occurred between Sher Afzal’s supporters and the police during his arrest. Despite the confrontation, police managed to arrest him and seize his vehicle.

Sources suggest that Sher Afzal was arrested due to legal violations committed during a rally, including disrupting the route, breaching commitments, attacking Islamabad police, and delivering anti-state speeches.

A week before the rally, Sher Afzal had declared he would be personally responsible if any violence occurred during the event.
