A Big Court Decision on Super Tax Could Impact Millions

The Federal Constitutional Court has upheld the legality of the Super Tax under Section 4C of the Income Tax Ordinance. The ruling overturns earlier decisions by the Islamabad High Court.

The court confirmed that the Super Tax is valid under the Constitution. It also reinforced the government’s authority to impose such levies through law.

The detailed judgment spans 293 pages. It was issued by Chief Justice Aminuddin Khan.

The court stated that the Super Tax must be treated as a separate levy. It is independent from the standard income tax system.

Judges ruled that Parliament has full authority to impose taxes on income. They added that the Islamabad High Court exceeded its jurisdiction in earlier directions to the Federal Board of Revenue.

The court clarified that the Super Tax applies from tax year 2022 onward. It covers all types of income, including those under special tax regimes.

It also stated that the levy is an additional charge and not a replacement for income tax.

According to the judgment, capital gains are also included under the Super Tax scope. However, petroleum and exploration companies may be subject to specific legal and contractual limits.

The court directed that welfare and pension funds must obtain proper certification for any exemption claims.

It also confirmed that retrospective taxation through legislation is legally valid.

At the same time, the court ruled that income already exempt under law will not be taxed under the Super Tax.

This includes certain property and share gains where exemptions apply. It also covers inheritance, long-term holdings, and agricultural income.

Legal experts say the ruling strengthens parliamentary control over taxation policies. It also supports the government’s ability to design fiscal measures.

The decision is expected to have a major impact on revenue collection and tax policy in Pakistan.
