The Supreme Court has ruled that sending cases back to lower courts for retrial is an exceptional legal power. The court said it should not be used as a routine practice. The decision aims to reduce delays in the justice system.
The judgment was issued by the Supreme Court of Pakistan. It clarified that appellate courts must decide cases on their own when the full record is already available. The Supreme Court emphasized that justice should not be delayed through unnecessary remands.
According to the ruling, remanding a case means sending it back to a subordinate court for a fresh hearing. The court said this step should only be taken when there is a strong legal reason. It described remand as a corrective and exceptional jurisdiction.
A two-member bench heard the case. It included Chief Justice of Pakistan Yahya Afridi and Justice Shahid Bilal Hassan. The bench converted a petition filed by Muhammad Zubair into an appeal and allowed it after review.
The case involved a family dispute. The issues included khula, dower, gold ornaments, and child maintenance. The court examined whether the matter required a new trial or could be decided based on existing records.
The judgment stated that appellate courts must avoid sending cases back without necessity. The Supreme Court observed that complete records should be used to deliver final decisions whenever possible. This helps reduce unnecessary delays in legal proceedings.
The court further explained that repeated remands increase litigation time. This places a burden on litigants and delays access to justice. It also affects public confidence in the legal system.
The ruling clearly stated that remand should only be used when essential. It is not meant to restart trials or prolong cases without valid justification. The court stressed that efficiency in judicial work is important.
Legal experts say the decision may help speed up court proceedings. It can reduce backlog in civil and family disputes where evidence is already complete. The Supreme Court has therefore set a strong guideline for lower and appellate courts.
