Aitzaz Files Petition In SC About Enforced Disappearances

Senior politician and lawyer Aitzaz Ahsan has submitted a constitutional petition in the Supreme Court to address the issue of enforced disappearances. Ahsan, known for his affiliation with the PPP and support for the PTI, has shown concern over the PTI members who went missing and criticized the PTI’s policies upon their return. He also highlighted the case of a pro-PTI TV host who disappeared for four months.

In the petition filed under Article 184(3) of the Constitution, Ahsan calls for the declaration that enforced disappearances violate several articles of the Constitution, including those related to the right of individuals, security of person, safeguards for arrest and detention, freedom of speech, and equality of citizens. He also requests the formation of a new, effective commission to address this issue, led by a Supreme Court justice and involving various stakeholders, including intelligence agencies, human rights organizations, and journalists.

Ahsan’s plea also addresses the matter of missing persons in Balochistan, emphasizing the historic challenges faced by the Baloch people. He disputes the number of missing persons mentioned by the caretaker Prime Minister and calls for the submission of an official list of disappeared individuals in state custody, an investigation into those responsible for enforced disappearances, and the release of all disappeared persons within four weeks.

Ahsan argues that there has been a surge in enforced disappearances and “re-appearances” of citizens, including journalists, politicians, and bureaucrats, and that these actions violate fundamental rights and international obligations. He names various government authorities and the Commission of Inquiry on Enforced Disappearances as respondents in the case.
