Tyrian White case: IHC asks Imran khan to ‘admit or deny’ having daughter.

[vc_row][vc_column][vc_column_text dp_text_size=”size-4″]ISLAMABAD: The Islamabad High Court (IHC) began hearings on Monday in a disqualification case against Pakistan Tehreek-e-Insaf (PTI) Chairman Imran Khan for concealing his alleged daughter Tyrian Jade White in his nomination papers.

A bigger bench of the Islamabad High Court, led by Chief Justice Aamer Farooq and comprising Justice Mohsin Akhtar Kayani and Judge Arbab Tahir, heard the matter and ruled that the former premier should’simply accept or deny having a daughter’.

Justice Farooq remarked at the commencement of the hearing that everyone has the right to privacy, but this matter is being heard in court owing to a legal concern. “Say anything you need to say in ‘yes’ or ‘no,'” he instructed.

“This is a two-minute case…either you admit or deny, and the hearing will conclude,” the IHC chief justice told Imran’s counsel.

“If you deny, the petition will be dismissed for the time being, and someone will bring this matter up again in the next election,” he said.

Judge Farooq stated that it is regrettable for someone’s private life to be made public, and he asked Imran’s counsel to adopt a firm stance.

Salman Akram Raja, the PTI chief’s lawyer, did not present in court. According to his assistant attorney, the petitioner has asked to alter his petition. “We object to his request and require time to reply in writing”.

The chief justice remarked that Imran’s response was barely two pages long and asked if he could submit it today.

The petitioner’s attorney provided a copy of the affidavit provided in the case of Imran’s purported daughter Tyrian being hidden.

According to Justice Kayani, “guardianship” is written in the affidavit, but there is no indication of being a father. “This is an ex-parte order and a foreign paper. This material cannot be considered full “He stated.

He further stated that the petitioner must demonstrate Imran’s recognition of his daughter. “Even if the girl has stated that he is her father, Imran Khan is not bound by this,” he continued.

According to Justice Kayani, the petitioner must present Imran’s confession in explicit language, admitting to being Tyrian’s father. “The petitioner must definitely demonstrate Imran’s paternity to Tyrian,” he stated.

“You must first establish that this girl is Imran Khan’s daughter. The question of Article 62(i)(f) will then arise “He went on to say.

The lawyer contended that Jemima and Imran had signed a no objection certificate, indicating their approval of Tyrian’s guardianship, and questioned why no one else had.

The IHC chief justice also inquired of the petitioner’s attorney whether they had a copy of the case filed there, implying that there must be some document for the judges to review.

According to the lawyer, all international records are in front of the court and have been certified by the Foreign Office. “If Imran Khan isn’t connected to Tyrian, why did he sign the guardianship affidavit?” he wondered.

According to Justice Kayani, many people are guardians of children but not dads. Relating to doing a DNA test, the court noted “it is only the girl who can claim that this is my father, how can a third person say it?”.

He stated that the only person who can go to court in this instance is Tyrian herself. “She can argue that my father should have declared me his daughter, but how did a third party become the victim in this case?” he wondered.

Chief Judge Aamer Farooq questioned if Imran Khan has responded in this case and for the petitioner’s attorney to produce the records. “Look over your materials thoroughly, categorise them, and report back to us at the next hearing. Show us whether or whether there was full ex parte action in California.”

The hearing was postponed until next Monday, March 20, and the court asked the petitioner’s lawyer to prepare and deliver its arguments at the next hearing.
