In an announcement made on Thursday, President Dr. Arif Alvi disclosed the decision to extend the tenure of three additional judges serving in the Peshawar High Court. The judges affected by this extension include Justice Fazal Subhan, Justice Shahid Khan, and Justice Dr. Khurshid Iqbal, according to a statement released by the President House Press Wing.

The renewed terms of service, as per the statement, officially commenced on January 18, 2024, and will remain in effect until a subsequent evaluation is carried out by the Judicial Commission of Pakistan. The President invoked the authority granted to him under Article 197 of the Constitution of Pakistan to exercise this extension of the judges’ service periods.

This decision holds significance as it underscores the constitutional provisions allowing for the President to use his discretionary powers to prolong the service of judges. Article 197 of the Constitution grants the President the authority to make such decisions, providing a legal framework for the extension of the tenure of judges.

It is noteworthy that the extension of judicial tenures is a measure often undertaken to ensure the continuity of experienced and seasoned jurists in the judiciary. By utilizing the discretionary powers granted to him, President Alvi has opted to retain the services of these three judges, acknowledging their contributions to the Peshawar High Court.

The extended period of service will persist until the Judicial Commission of Pakistan reviews and assesses the performance and qualifications of these judges. This reflects a commitment to a thorough and impartial evaluation process, ensuring that the extension is based on merit and the judges’ continued effectiveness in dispensing justice.

The President’s decision to extend the tenure of these judges aligns with the broader objective of maintaining a stable and competent judiciary in line with constitutional principles. The extension, granted within the constitutional framework, serves to uphold the integrity and effectiveness of the judiciary, a crucial institution in ensuring the rule of law and justice in the country.
