The Official Secrets (Amendment) Act 2023 and the Pakistan Army (Amendment) Act 2023 were declared as enacted into law on Saturday, reportedly after Alvi gave his consent.

Controversial legislation

The Official Secrets (Amendment) Bill specifies that a person will be deemed guilty of an offense if they intentionally disrupt public order or act against the state.

Additionally, damaging a prohibited location with the intention to directly or indirectly aid the enemy also constitutes an offense under the bill.

The amended bill stipulates that the accused will be tried in a special court, with a decision to be reached within 30 days after the completion of the hearing.

Meanwhile, the Army Act addresses the retirement of military personnel. According to this law, military personnel are prohibited from engaging in any political activity for two years following retirement, resignation, or dismissal. Those involved in duties of a sensitive nature are barred from participating in political activities for five years after their service ends.

A retired army officer found guilty of violating the Army Act can face up to two years of imprisonment. Moreover, if any serving or retired army personnel defame or ridicule the army on digital or social media, they can be penalized under the Electronic Crimes Act.

As per the law, any serving or retired officer who tarnishes the army’s reputation or spreads hatred against it will face imprisonment of two years and a fine under the Army Act.

Both pieces of legislation generated significant controversy during their initial proposals. After being approved by the National Assembly, the bills were presented in the Senate. However, following objections from treasury members, the Senate chairman referred the bills to the standing committee.

Later, some contentious clauses were removed from both bills, which were then reintroduced in the Senate. After gaining approval, they were sent to President Alvi for his endorsement.
