ISLAMABAD – The 27th Constitutional Amendment Bill has been introduced in the Senate, sparking major debate as it proposes creating a new Federal Constitutional Court (FCC), which critics warn could take over the Supreme Court’s top judicial role.
Supporters say the FCC will separate constitutional and appellate duties, reduce case delays, and improve clarity in the judicial system. However, many fear it will weaken the Supreme Court, shifting significant authority to the new court.
The amendment includes broader executive powers over the judiciary, like transferring High Court judges, and assigns stronger constitutional status to the Army Chief. It also states the FCC Chief Justice will retire at 68, three years later than Supreme Court judges.
While some legal experts warn of the Supreme Court becoming “a Supreme District Court,” others believe the reform aligns Pakistan with international judicial models and brings greater efficiency. The newly elected SCBA President has endorsed the proposal and is considering a nationwide lawyers’ convention to discuss it further.
