Omar Ayub Granted Relief By PHC In ECP Asset Declaration Case (1)

The Peshawar High Court (PHC) has stopped the Election Commission of Pakistan (ECP) from taking any action against Omar Ayub. The interim relief was granted on Monday during a hearing on a petition filed by the opposition leader in the National Assembly.

Omar Ayub had challenged a notice issued by the ECP regarding alleged non-declaration of his assets. A two-member PHC bench, consisting of Justice Ijaz Anwar and Justice Khurshid Iqbal, heard the case and issued a restraining order.

The petitioner’s lawyer told the court that the ECP had issued a notice asking Omar Ayub to submit details of his assets. The notice had given him 120 days to respond. The lawyer stated that his client had already submitted a reply within the given time. Therefore, any further action by the ECP was not justified.

He argued that, according to election laws, action can only be taken if a person fails to respond in time. Since Omar Ayub had already complied, the notice and any follow-up steps were unnecessary.

During the hearing, the Additional Attorney General informed the court that a similar case was already being heard in Abbottabad. In response, the PHC bench discussed whether the case should be transferred to Abbottabad or brought to Peshawar for a joint hearing.

The court then adjourned the proceedings but continued its order preventing the ECP from acting against Omar Ayub until the case is resolved.

This case relates to laws that require elected officials to submit yearly statements of their assets and liabilities to the ECP. These rules aim to ensure transparency and accountability in public office.

The PHC’s decision offers temporary relief to Omar Ayub while the legal process continues.
