Islamabad High Court Directs Imran to Approach Special Court Against Jail Trial

Imran Khan, the chairman of the Pakistan Tehreek-e-Insaf (PTI), has been ordered by the Islamabad High Court (IHC) to appeal his incarceration in the cypher case.

The cypher case concerns a diplomatic document that Imran allegedly lost control of. The United States allegedly threatened to remove Khan from office in the memo, according to the PTI.

On August 5, 2023, the PTI leader was found guilty and given a three-year prison term in the Toshakhana graft case. After that, he was transferred to the Attock prison, but the IHC eventually suspended his sentence. Khan, meanwhile, remained behind bars because to his court remand in the cypher case.

Shah Mahmood Qureshi, the former foreign minister and prime minister, was named as the main accused in the cypher case in a challan—a charge sheet—submitted on September 30 to the Special Court formed under the Official Secrets Act.

Imran has submitted a number of applications to the IHC, including one that asks the court to delay the Toshakhana decision, another that asks the court to halt the jail trial in the cypher case, and a third that challenges his October 17 indictment in the cypher case.

The appeal against the cypher case trial taking place at Adiala Jail was dismissed by the IHC today, and Imran was instructed to file a similar petition with the special court instead.

The reserved decision was now announced by IHC Chief Justice Aamer Farooq.

According to the ruling, the former premier was “favoured” in the jail trial due to security-related considerations. There doesn’t seem to be any malice towards the jail trial, it said.

The order stated that Imran had “numerous times” expressed his concerns about his security. The order noted, “If the PTI chairman has concerns about the jail trial, he may approach the trial court.”
