The Islamabad High Court (IHC) has reinstated Pakistan Telecommunication Authority (PTA) Chairman Major General (retd) Hafeezur Rehman. The IHC suspended the single bench ruling that had earlier removed him from office.
The case was heard by a two-member bench comprising Justice Muhammad Asif and Justice Inam Amin Minhas. Lawyers representing the PTA Chairman, Qasim Wadood and Salman Mansoor, argued that the single bench decision had granted relief not requested in the petition.
Counsel emphasized that the PTA rules were not challenged and the attorney general was not given proper notice, which is a legal requirement. The IHC noted that due process must be followed before any removal can take place.
During proceedings, the PTA’s lawyers highlighted that Hafeezur Rehman’s appointment had been approved by the federal cabinet and adhered to revised rules issued on March 25. They also addressed opposition regarding the advertisement of the PTA vacancy, noting that proper procedures were followed.
Earlier, on September 16, a single bench led by Justice Babar Sattar had declared Hafeezur Rehman’s appointment invalid. The bench had ruled that the selection process was legally flawed and directed the chairman’s immediate removal.
After reviewing arguments, the IHC suspended the single bench ruling, restoring Hafeezur Rehman as PTA Chairman until further proceedings. The court emphasized that the case will continue, and all parties must follow proper legal procedures.
Legal experts said the IHC’s decision ensures due process is observed in appointments and removals of key regulatory authorities. The move is expected to maintain stability in the telecom sector while the court completes its review.
The reinstatement highlights the IHC’s role in safeguarding procedural fairness and ensuring that administrative decisions follow legal standards.
