Human Rights Foundation Identifies Flaws In Imran Khan's Cipher Case Conviction

The International Human Rights Foundation has raised serious concerns regarding the conviction of Imran Khan, the founder of Pakistan Tehreek-e-Insaf (PTI), and Shah Mahmood Qureshi in the cipher case. The foundation pointed out that fundamental principles of justice were disregarded throughout the legal process.

In a recent development, Imran Khan, the former prime minister of Pakistan, and Qureshi received a 10-year prison sentence in the cipher case. The special court, presided over by Judge Abu Alhasnaat Zulqurnain, delivered the verdict at Adiala Jail, finding them guilty of leaking state secrets. The charges specifically revolved around the alleged retention and communication of a classified diplomatic cable sent by Pakistan’s ambassador to the US.

The International Human Rights Foundation, after conducting a thorough review of the legal proceedings, expressed deep concern over the lack of adherence to basic principles of justice and due process. The foundation’s statement highlighted several issues, including the denial of access to chosen legal counsel, the closure of the trial to the public, and the prohibition of cross-examination of prosecution witnesses. These, according to the foundation, constitute clear violations of rights established in international law, such as the right to a fair trial and the presumption of innocence until proven guilty.

The statement from the international rights body suggested that the charges against Khan and Qureshi appeared to be exaggerated, raising the possibility of a political agenda behind their prosecution. The foundation emphasized that such practices not only undermine the credibility of the legal system but also violate the fundamental principles of justice and fairness embedded in international human rights law. The lack of transparency and impartiality in the trials was seen as casting a shadow over the rule of law and the administration of justice in the concerned country.

The International Human Rights Foundation called unequivocally for the immediate quashing of the trial proceedings against Imran Khan and Qureshi. The foundation urged the withdrawal of all charges and the immediate release of the accused from custody. Additionally, a thorough and impartial investigation was advocated to determine the criminal liability of those involved in what the foundation termed a “miscarriage of justice.”

In essence, the foundation’s concerns highlight not only the legal intricacies of the case but also the broader implications for justice, human rights, and the rule of law in the country. The call for a comprehensive investigation underscores the need for accountability and transparency in legal proceedings, ensuring that justice is served in accordance with international standards.
