CJP Recuses Himself, Returns Bahria Town Property Auction Case To Bench

The Supreme Court was scheduled to hear Bahria Town’s appeal against the auction of its properties. The bench was headed by Chief Justice Yahya Afridi, commonly referred to as CJP Afridi.

However, the CJP chose to recuse himself from the case. He stated that it would be more appropriate for the previous bench to continue hearing the matter. Therefore, the case was sent back to the earlier panel for further proceedings.

Bahria Town’s lawyer informed the court that the Islamabad High Court had issued a detailed judgment regarding the case. The lawyer requested permission to submit additional arguments based on the judgment. The court granted this permission.

The earlier bench consisted of three members and was led by Justice Aminuddin. This bench had been handling the case before it was transferred to the CJP-led bench.

Following the CJP’s recusal, the Supreme Court adjourned the case indefinitely. No new hearing date has been set.

The decision by the CJP to step aside shows the judiciary’s care in managing complex cases. It also ensures consistency by allowing the original bench to continue the proceedings.

The Bahria Town property auction case has drawn significant public attention. Many are watching closely as the Supreme Court navigates through the legal process.

The CJP’s recusal reflects respect for judicial procedures and the importance of fair hearings. It allows the matter to be addressed thoroughly by the bench that first examined it.

The Supreme Court will inform parties when the case resumes. Until then, the previous bench will prepare for further arguments.

This development marks an important step in the ongoing legal battle involving Bahria Town and the auction of its properties.
