Billionaire Elon Musk serves as a White House employee and senior adviser to President Trump but does not hold a position within the Department of Government Efficiency (DOGE) or have any decision-making authority, the White House stated in a court filing on Monday.
According to the filing, signed by Joshua Fisher, director of the White House Office of Administration, Musk’s role is limited to advising the president and conveying presidential directives.
“Like other senior White House advisors, Mr. Musk has no actual or formal authority to make government decisions himself,” the document stated.

The filing, submitted in a case brought against Musk by the State of New Mexico, clarified that he is neither an employee of the U.S. DOGE Service nor the U.S. DOGE Service Temporary Organization. It further stated, “Mr. Musk is not the U.S. DOGE Service Administrator.”
Since Donald Trump began his second term last month, DOGE has been actively reshaping federal agencies, with Musk tasked with identifying and eliminating wasteful spending. This initiative has led to thousands of job cuts as part of a broader government overhaul.
