SC Overturns Article 63-A Ruling on Lawmakers’ Voting Rights

ISLAMABAD: The Supreme Court on Monday set aside its 2022 judgment on Article 63(A) of the Constitution which restricted lawmakers from casting votes against their party directives in the parliament.

The report said the five-member bench, headed by Chief Justice Qazi Faez Isa, with Justices Amin-ud-Din Khan, Jamal Khan Mandokhail, Mazhar Alam Khan Miankhel and Naeem Akhtar Afghan unanimously accepted a review petition against a previous decision.

The case centered on the court ruling that excluded votes cast by lawmakers from another party to their own who did not obey orders from their respective parties. The 3-2 majority judgement was, however, controversial with the SCBA describing the ruling as unconstitutional and a strike against legislative rights.

PTI lawyer Barrister Ali Zafar had raised objections regarding bench formation in the hearings, however, Chief Justice Isa dismissed the objections stating that court after keeping everything under consideration has decided to move ahead.
