[vc_row][vc_column][vc_column_text dp_text_size=”size-4″]ISLAMABAD: After being detained on suspicion of inciting uprising within institutions, a district and sessions court in Islamabad on Thursday ordered the immediate release of Lieutenant General (retd) Amjad Shoaib.
In its ruling today, the court overturned the three-day physical remand of Gen Shoaib, finding that “there was no verified evidence to support the allegations for remand”.

After an Islamabad magistrate filed a complaint against him on suspicion of inciting the populace against institutions and the government, Lt Gen (retd) Shoaib was detained.
Defense analyst Shoaib was detained at home after Magistrate Owais Khan submitted a first information report (FIR) at the Ramna police station, according to police sources.
The complaint was filed under sections 153A and 505 of the Pakistan Criminal Code, which, respectively, deal with inciting public disorder and fostering animosity among various factions.
According to the FIR, Shoaib said things that “incited government officials and opposition from completing their government and legal duties” during an interview with a private television channel.
Tahir Abbas Supra, an additional Sessions judge, deferred the judgement after hearing the parties’ submissions. After serving his two-day physical remand, Gen. Shoaib was brought before the court.
At the hearing, Shoaib’s attorney argued that Section 505 of the Pakistan Criminal Code did not apply to the case against him (statements inciting public mischief).
He added that the Supreme Court had made a ruling on the issue and that the controversy was related to holding provincial by-elections. The attorney continued by saying that if the choice had been made sooner, the arrest would not have taken place.
The prosecutor disagreed with Shoaib’s lawyer’s request to remove the former general from the case.
The court then mandated Amjad Shoaib’s immediate release.[/vc_column_text][/vc_column][/vc_row]
