After widespread protests erupted on May 9 following Khan’s detention, a two-member PHC bench comprised of Justice Ejaz Anwar and Justice SM Atiq Shah heard the plea under Section 3 of the Maintenance of Public Order (MPO).

When the petitioner’s counsel, Ali Zaman, claimed that the former minister was arrested under the Public Order Act, the advocate general informed the court that the government had the authority to arrest persons who violate law and order under MPO.

In response, Justice Anwar remarked that those who held a press conference were released, while those who did not were arrested again. The judge was referring to PTI officials who announced their resignation from the party after being arrested repeatedly.

Justice Anwar was perplexed as to how such serious claims could be concluded with a press conference. After the Islamabad High Court (IHC) ordered Khan’s release, the former federal minister was arrested by Khyber-Pakhtunkhwa police under the 3 MPO, according to Zaman.[/vc_column_text][/vc_column][/vc_row]
