Peshawar High Court Declares KP Reserved Seats Notification Null and Void

The Peshawar High Court has declared the Election Commission of Pakistan’s notifications on reserved seats in Khyber Pakhtunkhwa null and void. The court ruled that the seats must be reallocated using the correct proportional representation formula.

A two-member bench of the Peshawar High Court, led by Justice Syed Arshad Ali, ordered the Election Commission to complete the reallocation within 10 days. The court also stopped newly elected members on reserved seats from taking oath until the process is finished.

This decision followed a petition challenging the Election Commission’s allocation of reserved seats. The court found that the proportional representation formula was not applied properly.

Earlier, the Peshawar High Court had halted the oath-taking of reserved seat members in Khyber Pakhtunkhwa. The court questioned the Election Commission’s actions and asked for a detailed response.

The Supreme Court had recently restored 77 reserved seats to the ruling coalition in the National and provincial assemblies. This included seats in Khyber Pakhtunkhwa, Punjab, and Sindh.

The Peshawar High Court judgment impacts the allocation of these seats in Khyber Pakhtunkhwa. It requires fair and legal distribution to maintain transparency in the election process.
