The UK government has introduced major changes to its T2 Minister of Religion visa rules. The updated policy covers financial requirements, eligible religious occupations, and visa duration.
One significant change is the removal of the previous six-year maximum stay limit. The revised guidance also clarifies rules concerning immigration bail and certain cases of visa overstaying.
According to UK Visas and Immigration (UKVI), the visa allows foreign nationals to work in recognised religious positions. These include ministers, missionaries, and members of religious orders.
The immigration route also provides an opportunity to apply for permanent settlement. Applicants must meet the relevant eligibility and residence requirements.
Changes to Eligible Religious Roles
The revised rules introduce specific exceptions for members of religious orders. They will not face the general requirement that their roles must avoid mainly non-pastoral duties.
Non-pastoral responsibilities may include school teaching, media production, domestic work, and administrative tasks. Certain senior positions within religious organisations may also qualify for an exception.
Pastoral duties generally involve leading worship and delivering religious sermons. They can also include religious education, marriage ceremonies, funerals, and community counselling.
Providing spiritual guidance and supporting religious communities are also considered pastoral responsibilities.
Revised Financial Requirements for UK Visa Applicants
The UK government has updated the financial requirements for different categories of applicants.
Applicants who are not entitled to the National Minimum Wage must receive financial support from their sponsors. An A-rated sponsor must confirm accommodation and financial assistance throughout the applicant’s permitted stay.
Applicants entitled to the National Minimum Wage have different options. They can demonstrate personal savings of at least £1,270 held for 28 consecutive days.
Alternatively, an A-rated sponsor can confirm financial support of at least £1,270 during the applicant’s first month of employment.
Applicants extending their visas may also qualify for an exemption. They must have already lived legally in the UK for at least 12 months.
UK Removes Six-Year Maximum Stay Limit
Another major change concerns the maximum duration of the visa. The previous six-year overall stay restriction has been removed.
However, individual visa grants remain subject to specific duration limits. Applicants can receive permission for up to three years or their sponsored employment period.
The granted period will be whichever is shorter, plus an additional 14 days.
Successful applicants will receive an electronic visa, commonly known as an eVisa. They can access their immigration status through their UKVI account.
Eligibility Requirements for the Minister of Religion Visa
Applicants must meet several conditions to qualify for this immigration route. The visa requires a total of 70 eligibility points.
The points are divided into three categories:
- 50 points for a valid Certificate of Sponsorship.
- 10 points for meeting the financial requirements.
- 10 points for English language proficiency at B2 level.
Applicants must demonstrate English proficiency in reading, writing, speaking, and listening. Certain applicants may qualify for an exemption.
Candidates must also be at least 18 years old. Their Certificate of Sponsorship must have been issued within three months before applying.
Applicants must pay the required visa fee and Immigration Health Surcharge. They must also provide identity documents and biometric information.
A tuberculosis test certificate may also be required, depending on the applicant’s circumstances.
UKVI also requires applicants to demonstrate genuine intentions. They must be capable of performing their sponsored religious responsibilities.
Immigration Bail and Overstaying Rules
The revised guidance also explains how immigration status affects eligibility.
Individuals currently subject to immigration bail generally cannot qualify for this visa route.
However, certain periods of overstaying may be disregarded. Applicants must satisfy the conditions under the Exceptions for Overstayers provisions.
Work Rights and Family Members
Successful visa holders can bring eligible dependent partners and children to the UK. Their family members must meet the relevant dependant visa requirements.
Visa holders may also undertake additional employment for up to 20 hours weekly. However, the additional work must satisfy specific conditions.
It must take place outside their sponsored working hours. It must also involve the same profession at the same professional level.
Alternatively, applicants can undertake employment listed on the Immigration Salary List. Other additional employment may require separate sponsorship and immigration permission.
Visa holders can also study and undertake voluntary work under applicable conditions. However, they generally cannot access public funds.
Pathway to Permanent Settlement in the UK
The T2 Minister of Religion visa continues to provide a pathway to permanent settlement. Eligible applicants can apply after completing five years of qualifying continuous residence.
They must meet the applicable residence requirements and pass the Life in the UK test.
Applicants must also obtain confirmation from their sponsor. The sponsor must confirm that their continued employment remains necessary.
