Government Challenges IHC Ruling On Imran Khan's Jail Trial Legality

The caretaker government has taken legal action by approaching the Supreme Court to challenge the Islamabad High Court’s ruling on November 21, which declared the jail trial of former Prime Minister Imran Khan in the cipher case as illegal. The petition, jointly filed by the ministries of law and interior, argues that the IHC decision deviates from legal norms and goes beyond its jurisdiction.

To provide context, the Islamabad High Court had suspended Imran Khan’s sentence in the Toshakhana case on August 29. However, a special court, established under the Official Secrets Act, directed jail authorities to keep Imran in “judicial lockup” in connection with the cipher case. On the same day, the law ministry issued a notification stating that the Law and Justice Division had “no objection” to holding Imran’s trial in the cipher case at Attock jail. Subsequently, in September, Imran Khan was shifted to Adiala jail.

The caretaker government’s appeal contends that the Islamabad High Court’s ruling lacks conformity with legal principles and jurisdictional boundaries.
