Canada has warned foreign nationals against working without proper authorization, saying violations could lead to serious immigration consequences.
According to Canadian immigration authorities, unauthorized work can result in removal from the country and a ban on returning for up to five years.
Foreign nationals who work illegally could also receive a permanent fraud record with immigration authorities. This may affect future applications, including requests for permanent residence.
Canadian authorities have also warned that unauthorized workers can face greater risks of exploitation. These risks include unpaid wages, unsafe working conditions, abuse, threats and forced labour.
Officials clarified that having a Canadian visitor visa or electronic travel authorization does not give anyone permission to work in Canada.
Most visitors are also not eligible to apply for a work permit from inside Canada. Foreign nationals must therefore ensure they have the correct authorization before starting employment.
Temporary foreign workers have been advised to follow all conditions listed on their work permits. Workers who need an extension should generally apply at least 30 days before their current permit expires.
Those who submit an extension application before their permit expires may be allowed to remain in Canada under maintained status while the application is processed, subject to applicable conditions.
However, workers must stop working if their permit expires before they submit an extension application. Violating work permit conditions can result in inadmissibility and possible removal from Canada.
Canadian authorities have also urged foreign nationals to remain alert to immigration and employment scams. Fraudsters may demand money in exchange for jobs, work permits or promises of permanent residence.
Officials warned against offers received through social media and misleading claims about how long a person can legally stay in Canada.
Temporary foreign workers are protected under Canadian labour laws once they are legally employed. Employers must pay workers and provide a safe workplace.
Employers also cannot take away workers’ passports or work permits. Workers facing abuse or exploitation can seek help through the appropriate Canadian authorities.
International students must also follow the employment conditions attached to their study permits. They must comply with applicable limits on off-campus working hours.
Students who work beyond permitted hours could face serious consequences. These may include losing student status, refusal of future study or work permit applications and being required to leave Canada.
Graduates generally need a work permit to continue working in Canada after completing their studies. Eligible applicants for a post-graduation work permit may, however, be allowed to work full-time while awaiting a decision if they meet the required conditions.
